Terms of service
Version of
These terms of service apply to everyone who has a Marbly account, customers and providers alike. By creating an account or signing in, you accept them. Marbly is in beta, so its features can change.
These terms are in Finnish and English. If the two versions differ, the English version prevails.
1. Marbly and how to reach us
- Company: [to be added: company name], which runs Marbly
- Business ID (Y-tunnus): [to be added: business ID]
- Address: [to be added: postal address]
- Email: [to be added: email address]
This email address is also our single point of contact for users and for authorities. You can write to us in Finnish or English.
2. Who can use Marbly
- You must be at least 18 years old and able to make a binding contract.
- You may have one account.
- The details you give must be true, and you keep them up to date.
- You keep your password safe and do not share your account.
- If you act for a company as a provider, you must have the right to bind that company.
3. What Marbly is, and who does what
Marbly is a marketplace that connects customers with providers of services for events, such as catering. A booking is a contract between the customer and the provider. Marbly is not a party to that contract.
- Marbly runs the service and passes requests and messages between customers and providers. Before a booking, Marbly hides contact details in messages. Marbly does not forbid you from arranging a booking outside Marbly.
- The provider is responsible for their service, its price and delivery, and for the permits and safety rules the law requires for it. A provider whose service includes food is also responsible for food safety.
- The customer is responsible for the event details and for telling the provider what they need to know, such as guests' diets and allergies when food is served.
4. Providers acting as a business or as a private person
If the provider is not a business, EU consumer protection law does not apply to the contract between you and the provider.
[to be added: whether a private person can be a provider on Marbly, and how Marbly shows whether a provider acts as a business. Question Q7 in the SCRUM-167 plan, decided by the founders.]
5. Bookings, prices and payment
You send a request to a provider. The provider answers with an offer, and when you accept it, the booking is made between you and the provider.
During the beta, Marbly charges nothing and takes no payments. The customer and the provider agree on the price and the payment between themselves. These terms will change before Marbly adds payments or fees.
6. Cancellations
The cancellation terms that apply to a booking are the ones shown when the booking is confirmed. Each provider sets their own.
Catering and leisure services booked for a specific date, such as most services for an event, have no 14-day right of withdrawal. If the law gives you that right for another service, the provider tells you before the booking.
7. Food, allergens and diets
This section applies when a service includes food. The provider gives the allergen and food information the law requires before the booking. The customer tells the provider about the guests' diets and allergies. Marbly passes these details on but does not check them.
The privacy policy, section 4, explains how we handle dietary details.
8. What a provider may publish
- You may publish only content that you have the right to publish.
- You promise that every person who can be recognised in your photos has given you permission to publish them.
- A person in a photo can ask Marbly to remove it, and Marbly removes it.
- You keep ownership of your content. You allow Marbly to show it on Marbly, and to resize and crop it for that purpose, for as long as it is published.
9. Messages
Messages are for arranging a booking. Harassment, spam and illegal content are not allowed. Before a booking, Marbly hides contact details in messages. Marbly staff read a message only to settle a dispute or a report, as the privacy policy explains.
10. Reviews
Only a customer who has booked a provider can review them, and only after the event. This is how Marbly checks that a review comes from a real customer.
A review must be honest and about the booking. It must not contain insults, personal data about others or illegal content. The provider can reply to a review.
11. How search results are ordered
[to be added: the main things that decide the order of search results, and how much each one weighs. The search feature is not built yet. The ticket that builds it updates this section in the same release.]
12. Reporting content, and what Marbly may remove
You may not publish illegal content, content that breaks someone else's rights, or content that breaks these terms.
You can report content to the email address in section 1. A person at Marbly reads each report and decides on it; Marbly makes no automated decisions during the beta.
Marbly may hide a review, remove a photo or other content, or restrict a provider page or an account. Marbly tells the person affected what it did and why, and applies these rules fairly and in proportion to the problem.
13. Restricting, suspending or closing an account
Marbly may restrict, suspend or close an account if its holder breaks these terms or the law, gives false details, or puts others at risk.
A provider is told the reasons before or when the restriction or suspension takes effect. Marbly gives a provider 30 days' notice before closing their account for good, unless the law, or repeated serious breaches of these terms, require it to act sooner.
14. Closing your own account
You can ask us to close your account at any time, at the email address in section 1. Open bookings must be completed or cancelled first. The privacy policy, section 8, says what we keep after that and for how long.
15. Data, and who can access it
The privacy policy says what data customers, providers and Marbly can see, and what happens to a provider's data when they leave.
Marketing messages are never part of these terms. We ask for that consent separately, and you can withdraw it at any time.
16. Liability
Marbly is not responsible for the provider's service, or for a contract it is not a party to. Marbly's own liability is limited as far as the law allows. Nothing in these terms limits the rights a consumer has by law.
17. Complaints and disputes
Take a complaint about a booking to the other party first. Send a complaint about Marbly to the email address in section 1.
If you are a consumer, the Finnish Consumer Advisory Service (Kuluttajaneuvonta) can help you, and you can take a dispute to the Consumer Disputes Board (Kuluttajariitalautakunta).
Marbly does not handle complaints or disputes about a deal made outside Marbly.
18. Governing law
Finnish law applies to these terms. If you are a consumer, you keep the protection of the law of the country where you live.
19. Changes to these terms
Each change is a new version with a new date, and older versions stay available.
- A material change is announced by email before it applies. Providers get at least 15 days' notice.
- If you do not accept a change, you can close your account before it applies.
- A minor change, such as a typo or clearer wording, only updates the date at the top of this page.
